Accommodation Terms and Conditions
Article 1 [Scope of Application]
1. Any matters not stipulated in these Terms and Conditions of Accommodation Contracts and related contracts between this hotel and a guest shall be governed by laws and regulations and/or generally established practices.
2. In the event that the Hotel has entered into a special contract with a Guest insofar as this does not violate laws, regulations and generally accepted practices, notwithstanding the provisions of the preceding paragraph, the special contract shall take precedence.
Article 2 [Application for Accommodation Contract]
1. A person who intends to apply for an Accommodation Contract with the Hotel must provide the Hotel with the following particulars:
(1) Name of guest (2) Date of stay and expected arrival time (3) Accommodation fee (in principle, based on the Basic Accommodation Fees in Appendix 1)
(4) Any other matters deemed necessary by the Hotel 2. If a Guest requests, during his/her stay, to extend his/her stay beyond the date of accommodation specified in subparagraph 2 of the preceding paragraph, the Hotel shall treat it as if he/she had applied for a new Accommodation Contract at the time such request was made.
Article 3 [Conclusion of Accommodation Contracts, etc.]
1. An accommodation contract shall be deemed to have been established when the hotel accepts the application as stipulated in the preceding article. However, this shall not apply when the hotel proves that it has not accepted the application.
2. When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, an application fee set by the Hotel, limited to the basic accommodation charges for the accommodation period (if it exceeds 3 days, for 3 days), shall be paid by the date designated by the Hotel.
3. The application fee shall first be applied to the accommodation fee finally payable by the guest, and in the event of the occurrence of a situation to which the provisions of Articles 6 and 18 apply, it shall be applied in the order of penalty charges and compensation, and the remaining balance, if any, shall be refunded at the time of payment of the fee as provided for in Article 12.
4. If the application fee stipulated in paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same paragraph, the Accommodation Contract shall become void. However, this shall only apply if the Hotel has so notified the Guest when specifying the due date for payment of the application fee.
Article 4 [Special agreement not requiring payment of a deposit]
1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no application deposit after the Contract has been concluded.
2. If the Hotel has not requested the payment of the application fee stipulated in Paragraph 2 of the preceding Article and/or has not specified a due date for the payment of the application fee when accepting an application for an Accommodation Contract, it will be treated as if the Hotel had accepted a special contract stipulated in the preceding Paragraph.
Article 5 [Refusal to Conclude an Accommodation Contract]
The Hotel may refuse to enter into an Accommodation Contract under any of the following cases:
(1) When an application for accommodation does not conform with these terms and conditions.
(2) When the Hotel is fully booked and there are no rooms available.
(3) When a person seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate the provisions of the law, the public order or good morals in regard to his/her accommodation.
(4) When the person seeking accommodation is deemed to be under any of the following items (a) to (c):
(a) An organized crime group as defined in Article 2, paragraph 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Members (Law No. 77 of 1991) (hereinafter referred to as an "organized crime group"), an organized crime member as defined in Article 2, paragraph 6 of the same Law (hereinafter referred to as an "organized crime member"), an associate member of an organized crime group, or a person related to an organized crime group, or other anti-social forces; (b) A corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member; or (c) A corporation with any person among its officers who is a member of an organized crime group. (5) When the person seeking accommodation makes an unreasonable demand against the hotel or the hotel staff by using violence, threats, extortion or intimidating acts, or when the person requests an unreasonable burden.
(6) When the person seeking accommodation is a patient, etc. of a specific infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Inns and Hotels Act (hereinafter referred to as a "Patient, etc. of a specific infectious disease").
(7) When the Hotel is unable to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable reasons.
(8) When the person seeking accommodation is deemed to be causing trouble to other guests.
Article 6 [Right of Guest to Cancel Accommodation Contract]
1. A Guest may cancel the Accommodation Contract by notifying the Hotel.
2. In the event that the Guest cancels the Accommodation Contract in whole or in part due to reasons attributable to the Guest (except in the event that the Hotel has specified a due date for the application fee and requested payment pursuant to the provisions of Article 3, Paragraph 2 and the Guest cancels the Accommodation Contract prior to such payment), the Hotel shall charge a penalty as listed in Attached Table 2. However, in the event that the Hotel has accepted a special contract as set forth in Article 4, Paragraph 1, this shall apply only when the Hotel has notified the Guest of the obligation to pay the penalty in the event that the Guest cancels the Accommodation Contract, in accepting such special contract.
3. If a guest does not arrive by 9 p.m. on the day of the stay (or by two hours after the expected arrival time if the guest has been clearly stated in advance) without contacting the hotel, the hotel may regard the accommodation contract as having been cancelled by the guest.
Article 7 [Right to Cancel Hotel Contract]
1. The Hotel may cancel the Accommodation Contract in any of the following cases:
(1) When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws and regulations, the public order or good morals in regard to his/her accommodation, or when he/she is deemed to have conducted such conduct.
(2) When the Guest is deemed to be one of the following (a) to (c):
(a) A criminal organization, a member of a criminal organization, a semi-regular member of a criminal organization, or a person related to a criminal organization or other anti-social forces; (b) A corporation or other organization whose business activities are controlled by a criminal organization or a member of a criminal organization; (c) A corporation with an officer who is a member of a criminal organization. (3) When the person seeking accommodation has made violent, intimidating, blackmailing or coercive demands against the hotel or the hotel staff, or has requested an unreasonable burden, or is deemed to have engaged in similar behavior in the past.
(4) When the guest is a patient of a specific infectious disease.
(5) When violent demands are made in relation to the accommodation, or an unreasonable burden is asked of the Hotel.
(6) When the Hotel is unable to provide accommodation due to a natural disaster or other force majeure.
(7) When the Guest smokes in bed, tampers with fire-fighting equipment, or fails to comply with other prohibited actions stipulated by the Hotel (limited to those necessary for fire prevention purposes).
2. When the Hotel cancels the Accommodation Contract in accordance with the provisions of the preceding paragraph, the Hotel shall not charge the Guest for any accommodation services, etc. that he/she has not yet received.
Article 8 [Accommodation Registration]
Guests are required to register the following particulars by the day of their stay:
(1) The guest’s name, date of birth, sex, address and contact details. (2) In the case of a foreigner not residing in Japan, the guest’s passport number. (3) Any other information deemed necessary by the Hotel.
Article 9 [Guest Room Occupancy Hours]
1. Guests may occupy the hotel guest rooms from 3:00 p.m. on the day of stay until 10:00 a.m. the following morning. However, in the case of consecutive stays, guests may occupy the guest rooms all day, except on the days of arrival and departure.
2. Notwithstanding the provisions of the preceding paragraph, the Hotel may permit the Guest to occupy the room outside the hours specified in the same paragraph. In this case, the following additional fees will be charged.
(1) 2,200 yen (tax included) for each additional hour (however, extension is limited to 2 hours). Any extension less than an hour will be rounded up to the next hour.
(2) If check-out is after 12:00, the charge will be equivalent to one night's accommodation fee.
Article 10 [Observance of Terms of Use]
Guests are required to observe the Hotel Usage Regulations established by the Hotel and posted within the premises of the Hotel.
Article 11 [Business Hours]
1. The opening hours of the main facilities of our Hotel will be provided in the brochures provided.
2. The times stated in the preceding paragraph may be subject to temporary change due to unavoidable circumstances related to the operation of the hotel. In such cases, we will notify you by appropriate means.
Article 12 [Payment of Fees]
1. The breakdown of the accommodation fees, etc. to be paid by the Guest shall be as set forth in Attached Table 1.
2. Payment of accommodation fees, etc., as set forth in the preceding paragraph shall be made by a payment method approved by the Hotel at the time of booking.
3. Accommodation fees will be charged even if the Guest voluntarily does not stay in the room after the Hotel has provided it to the Guest and made it available for use.
Article 13 [Liability of the Hotel]
1. When the Hotel has caused damage to a Guest in the fulfillment or non-fulfillment of the Accommodation Contract and/or related agreements, the Hotel shall compensate such Guest for such damage, unless such damage has been caused by reasons not attributable to the Hotel.
2. Our hotel is covered by hotel liability insurance in order to cope with the unlikely event of a fire or other incident.
Article 14 [Handling when contracted rooms cannot be provided]
1. When the Hotel is unable to provide a contracted room to a Guest, it will, with the Guest's consent, arrange accommodation of the same standard elsewhere for the Guest, wherever possible.
2. Notwithstanding the provisions of the preceding paragraph, if the Hotel is unable to arrange alternative accommodations for the Guest, the Hotel shall pay the Guest a compensation fee equivalent to the breach of contract charges, which shall be applied to the amount of damages. However, if the Hotel is unable to provide a room due to reasons beyond the Hotel's control, the Hotel shall not pay the compensation fee.
Article 15 [Handling of Deposited Items, etc.]
The Hotel shall compensate the Guest for any damages incurred by the Guest with regard to goods, cash or valuables brought into the Hotel when such damages are caused through the Hotel's willful misconduct or negligence.However, for any items for which the Guest has not reported the type and value in advance, the Hotel shall compensate the Guest up to a maximum of 10,000 yen, except in cases where such damages are caused by the Hotel's willful misconduct or gross negligence.
Article 16 [Care of Guest's Baggage and Belongings]
1. If a guest's baggage or belongings are left behind at the hotel after checking out, they will be stored in the operating company's office for seven days, including the day they are found, and if the rightful owner requests it within that storage period, it will be returned in accordance with their instructions. After the storage period has expired, the property will be handled in accordance with the law. However, the cost of returning the property will be borne by the person who requests the return of the lost property.
2. The Hotel's liability regarding the custody of the Guest's baggage and belongings in the case of the preceding paragraph shall be in accordance with the provisions of Paragraph 1 of the same Article.
Article 17 [Parking Responsibility]
When a guest uses the hotel's parking lot, regardless of whether the key to the vehicle has been deposited with the hotel, the hotel is merely lending the space and is not responsible for the management of the vehicle. However, if the hotel causes damage through intentional or negligent acts on the part of the hotel in managing the parking lot, the hotel will be liable to compensate for such damage.
Article 18 [Liability of the Guest]
1. When the Hotel suffers damage caused by the Guest's intention or negligence, the Guest shall compensate the Hotel for such damage.
2. If a person other than a guest is allowed into a guest room (entering the room without permission, staying overnight, etc.), or if the number of guests staying at the hotel is increased without prior notice to the hotel, a penalty of 11,000 yen (tax included) per person (excluding guests) will be charged.
